1. Acceptance of Terms
By accessing or using the Ãhãra website, mobile application, or placing an order with us, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Use of Our Services
You agree to use our services only for lawful purposes. You may not:
- Use our services in any way that violates applicable laws or regulations
- Attempt to gain unauthorized access to our systems
- Submit false or misleading information
- Engage in any conduct that disrupts or damages our services
3. Orders and Payments
By placing an order, you represent that you are authorized to use the payment method provided. All orders are subject to availability and confirmation. We reserve the right to refuse or cancel any order at our discretion.
Prices are subject to change without notice. All applicable taxes will be calculated and displayed at checkout.
Credit card surcharge: A surcharge of up to 4% may be applied to orders paid by credit card, as permitted under North Carolina law. This surcharge is disclosed at checkout before payment is confirmed. Debit card and cash payments are not surcharged.
Tips: An optional tip may be added at checkout. Tips go directly to our team and are entirely at your discretion.
4. Cancellations and Refunds
Orders may be cancelled within a reasonable time before preparation begins. Once an order has been prepared or is out for delivery, cancellations may not be possible. Refunds for quality issues will be evaluated on a case-by-case basis. Please contact us directly for assistance.
5. SMS Notifications
When you place an order and provide your phone number, you consent to receive transactional text messages about your order (confirmation, preparation status, ready for pickup, and completion). Message frequency varies per order (typically 2–4 messages). Standard message and data rates may apply. Reply STOP to opt out or HELP for assistance.
6. Rewards Program
Āhāra offers a loyalty rewards program for registered account holders. Points are earned on qualifying purchases based on the subtotal (excluding tax, tip, and surcharge). Points have no cash value and may not be transferred. We reserve the right to modify, suspend, or terminate the rewards program at any time. Points may expire if your account is inactive or the program is discontinued.
7. Allergen Disclaimer
Our kitchen handles a variety of ingredients including common allergens such as nuts, gluten, dairy, eggs, soy, and shellfish. While we take reasonable precautions, we cannot guarantee that any menu item is completely free of allergens. Please notify our staff of any dietary restrictions or allergies before ordering.
8. Intellectual Property
All content on this website, including text, images, logos, and branding, is the property of Āhāra and protected by applicable intellectual property laws. You may not reproduce, distribute, or use our content without express written permission.
9. Limitation of Liability
To the maximum extent permitted by law, Āhāra shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount paid for the specific order giving rise to the claim.
10. Indemnification
You agree to indemnify and hold harmless Āhāra, its employees, and agents from any claims, liabilities, damages, or expenses arising from your use of our services or violation of these Terms.
11. Governing Law
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law provisions. Any disputes shall be resolved in the courts of Wake County, North Carolina.
12. Changes to These Terms
We may update these Terms of Service at any time. Continued use of our services after changes are posted constitutes acceptance of the revised terms.
